There are hereby incorporated by reference zoning regulations adopted by the governing body of the City of Winchester, as prepared by the city and incorporated by Ordinance No. 96-16-301 and entitled “Zoning Ordinance, Winchester, Kansas”. One copy of zoning regulations marked “Official Copy as Incorporated by the Code of the City of Winchester” and to which there shall be a published copy of this section attached, shall be filed with the city clerk to be open for inspection and available to the public at all reasonable business hours.

Said regulations have subsequently been amended by Ordinance No. 18-16-501.

(a)   For the purpose of wholly or partially defraying the costs of processing applications for actions taken under the Winchester Zoning Ordinance, there is hereby established a schedule of fees as follows:

(1)   Application for Rezoning or Conditional Use (no separate fee for Development Plan): $100.00

(2)   Application for Development Plan Approval separate from Rezoning or Conditional Use application: $50.00

(3)   Application for Variance, Special Exception or Appeal to the Board of Zoning Appeals: $50.00

(4)   Application for Sign Permit: $10.00

(b)   All costs associated with recording documents, placing legal publications, and mailing notifications to adjoining landowners shall be payable in addition to the fees stated in subsection (a). These will be separately billed to the applicant and must be paid prior to final disposition of the application.

(c)   No fee shall be refunded in any event.

(d)   A written receipt shall be issued to the person(s) making payment of the fee. No fee shall be required when a proposal concerns land owned by any township, city, the county, the state, or the federal government, nor any agency, board, or legal entity thereof; nor from any public school or college.
